Ever been through a succesion after a parent dies?

After the Judge signs the Order of Possession, how is the money that was in bank accounts distributed to the beneficiaries?

The executor or executrix is charged with effecting distributions. They are (by law) entitled to a small percentage for this task.

Is it a percentage or can they recoup their expenses? I was under the impression they could recoup expenses.

If a family member or close friend, it is usually for free (when I did it, it stated in the Will that I was to perform the normal duties for free less any reasonable expenses). Typical expenses requiring reimbursement are Fed Ex charges, having things appraised, etc. Attorney fees were all billed and paid out of the estate account.

You write the beneficiary a check from the estate account for the appropriate amount.

The executor or executrix can take a fee but it is pretty small. I'm not sure about expenses but probably so.

But if it has already been signed off by a judge I don't think you can go back and request.

And why is it that an Attorney has to be used for a simple succession? Pisses me off that they get paid for something that I should be able to go down to the Clerk's office with a certified Death Certificate and fill out a form to do.

And as a client, I'd rather have an attorney that doesn't spend most of his day on message boards. But thanks for the helpful info.

the attorney charged us $2500 for the succession when my mom passed away. I didn't think that was bad considering what attorneys charge for anything these days.

Government takes 85%. The rest goes to the family according to will.
