This article is terribly written, but the premise is horrifying.

The waitress spent the night in jail, had her alcohol server's permit revoked because of the arrest. After four months, prosecutors dismissed all her charges -- because the blood test came back completely clean.

"You had to spend months -- and thousands of dollars -- proving your innocence," Keefe said.

"I did," Ebner said.

Don't look like a pot head in our state and you won't be treated as such. It's a simple thing to avoid.

So it's ok to arrest someone who hasn't been drinking, doesn't smoke marijuana, has neither in their possession and asks to take a drug test, all because a law enforcement officer says he thinks they're impaired, even when objective scientific tests state otherwise? Yeah, that's not ripe for abuse.

frick that. Is it even legal for him to arrest her if she passed the alcohol test and there was no physical evidence of her smoking marijuana?

I know this is bait, but I'll bite:

Do you think people should be arrested for a subjective belief about a person's general appearance, with no supporting evidence whatsoever?

Had a similar situation personally.

Cop approached the car and said it smelled of marijuana. I was arrested for DUI Alcohol, it was later changed to controlled substance.

They didn't give me a blood, breath, or urine test.

It was dismissed in court, but I had to bond out and pay all the bullshite fees plus a lawyer.

I was pulled over once and the guy asked if I had smoked marijuana.

I wore contacts all through college. My eyes were always red after 12 hours of contact usage (day wear only); moreso when I was around smokers. He wanted to arrest me.

Luckily, a PD friend pulled up and talked to the retard trying to arrest me.

On my way home from work I went through a DWI check point. I was tired after a twelve hour shift. The cop asked me to step out of the vehicle and do a drunk test. This guy shined one of those super bright flashlights right in my eyes. All I could see were spots. It was close, I really thought I was going down.

I had lasik surgery after college. I haven't had those problems since that incident.
