Did they change the open container laws in downtown BR?

I was on third street last night. Police were going around telling bouncers starting today they are not going to allow open containers on the sidewalks/street. I overheard and said to the officer, "that's not right, the city ordinance has an exception for 3rd Street and the downtown development district."

(I know, I'm a genius for trying to argue the law with a cop)

The cop told me I was wrong and they have just been letting people do it, but they are going to start enforcing it.

When the cop walked away I told the bouncer the cop was full of shite. He was.

Sec. 13:1018. - Public drinking prohibited.

Do you know what happened specifically? A friend of mine was there with a cooler and he didn't mention anything.

Regardless if you think he is wrong, you do it, you're doing to get a ticket.

He may "get" one but he won't pay a fine.

Do people still go downtown? Seems like you don't hear about it as much these days compared to a couple years ago.

Read your proof...no where does it allow you to walk the streets with a beer. This allows you to sit out side of a business and drink when it is a restaurant not a class a bar.


Sec. 15:325. - Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

(1)
Permit holder means the recipient of a sidewalk café permit under the terms and provisions of this chapter.
(2)
Restaurant means an eating establishment, including but not limited to, coffee shops, cafeterias, sandwich stands, and school cafeterias, which gives or offers for sale food to the public, guests, or employees. A restaurant shall not include an establishment holding a Class A (bar) license from the city-parish ABC office.
(3)
Sidewalk means that portion of the street between the curb lines or the lateral lines of a roadway and the adjacent property lines intended for use by pedestrians.
(4)
Sidewalk café means portion of a restaurant located on a public sidewalk or mall which functions as an extension of the use of the adjacent public property by a restaurant as approved by the development director.
(5)
Temporary means that the entire arrangement on the sidewalk can be removed immediately as required for emergencies and pedestrian use.

Live After 5 used to have special rules that allowed open container. Probably still the case, but hell, I haven't been to one of those in five or six years.

Went to Live After 5 about a month ago and it was packed. Brought my own beer and walked around without issue.
