Can you really park in handicap parking spots that still don't have the signs?

There's an internet spat over this TPOS grandpa's pic.

I was under the impression that spots created before 2012 didn't have to have the sign on a pole, so long as they are not in need of maintenance.

There was a service dog in the restaurant which needed dispatching. A former EBRPSO cop now in Lafayette switched back to his original training when he got the call and found the first parking spot available.

Nothing to see here folks, move along, resume your normal lives.

I'm being inconsiderate but why do handicapped people with motor scooters need the spot either?

From Indiana Code (from the website on the bumper, this is Lafayette, Indiana not Lafayette, LA) LINK:

So if I'm reading it correctly, the space has to have a vertical sign also.

But I bet that cop wouldn't hesitate to write a ticket to someone else without a handicapped tag.

How are they going to unload them in a normal spot?

Right, but those laws didn't apply to construction before March 2012 and looking at google street view, both handicap spots look like this so that means the cop did 1 of 2 things.

A) Saw the handicap spot and didn't give any fricks.
B) Saw that IHOP didn't have any legal handicap spots and thus is in violation in the law and didn't give any fricks.

If they load from the side then they may need that van accessible spot.

Some cops will say they park that close in case they have to leave real fast, but how come they don't back in?
