Theres a hearing on whether the Landrieu admin can pull down the statues starting about now. Anyone in the audience? Best source that I found was a NO Advocate reporter on twitter.

Can any legal experts provide context about the law that may prevent the monuments from being removed?

A Baton Rouge company that was hired by the City of New Orleans to remove several Confederate monuments is backing out of the job, after its employees received death threats and other area businesses threatened to cancel existing contracts with the firm. In a letter to the City of New Orleans dated Tuesday, Baton Rouge attorney Roy Maughan Jr. says his client, H&O Investments, is “unable to perform the tasks originally assigned in association with the removal of the monuments for the City of New Orleans.” The letter says the offices of H&O, which is owned by David Mahler, has received numerous telephone complaints, including death threats directed to Mahler and his staff. Mahler’s wife has also received threatening calls at the couple’s residence, the letter adds. “These telephone calls, unkindly name-calling and public outrage expressed in various social media, as well as other area businesses threatening to cancel existing contracts with H&O, have precipitated H&O’s cessation of work,” Maughan says in his letter.

Barbier seems to be suggesting the City Council has flexibility to make political decision of whether the statues should be removed.

Barbier seems very skeptical of arguments being made by plaintiffs

Barbier: Why does the city need to have an ordinance to take down the monuments? Doesn't it have the right to say what's on its property?

Barbier: I didn't understand (from suit and briefs) that you were arguing that the city code provision itself was unconstituional
This doesn't seem to be going well for those who want to keep the statues up.

They need some laws to protect the statues. Statue statutes.

My bet is that these statues are gone as soon as the ink dries on his decision.

Barbier outright rejects that argument

Attorney is arguing that a part of the nuisance argument specifically dealing with the Liberty Place court order should apply to all statues

Barbier is a goof. Having had him hear a trial that I was involved in, I got the feeling he just doesn't give a shite about the law, and just takes the path of least resistance.

Dude is getting crushed.

Sad day when these statues come down. Pathetic, truly.

Don't read to much into that.

Lawyer for City says "death threats were made to original contractor". So they need to find a new contractor.
so now that is officially said in open court

I would say this hearing seems to be the final straw, pathetic if the city goes through with this.

not condoning this 1 bit... but it seems like if the city can't find a contractor to do it... then nothing's going to happen

City says intent is not to destroy statues but to move them off of public property to some sort of Civil War historical area.
but didn't the city get rid of the Confederate/Civil War museum like 10-12 years ago?
Posted on 1/14/16 at 10:56 am to rt3
Yeah, the building is now part of the Ogden Museum. Nothing civil war about it except the cannon and the sign out front. The building is gutted and now a reception facility for Ogden

Huh? Still there...oldest museum in LA.

Worth noting that John Cummings - who has been rumored to be anonymous donor - wants to make a civil war statue park at Whitney Plantation

Cummings has denied he is the anonymous donor, however.

don't know where they have all of that. Unless it is on some other level, but the two levels that I saw were gutted

Barbier to city: "I think your argument is that if you can put these up, you can take them down." City's attorney agrees
