Any of you baws had a neighbor's tree fall on your vehicle? What did you do or didn't do? I've contacted my car insurance, talked with the neighbor and he's giving me his insurance info and I had a police report (didn't know the neighbors due to recent sale of house and no one was home).

Act of God. You'll be filing a comp claim.

My neighbors don't have any trees in my 12 car garage.

Unless your neighbors tree was rotten and a reasonable person had reason to know it, this will be an auto comprehensive claim. Not your neighbors problem.

Unless your neighbor knew the tree was rotten or a serious hazard and did nothing about it, your insurance will be the ones handling it.

Was it an obviously dead limb?

The tree has had a limb fall on the fence before and the previous owner's insurance paid for damages due to the tre being rotted through the center, you could see daylight through the tree.

Still an act of God or lack of maintenance from previous owners? Poor new guy didn't notice the tree before buying.

Your neighbors insurance will tell you to pound sand.

Call your insurance now. It's their responsibility and you have to pay the deductible.

It sucks.

Your insurance will have to cover this. Happened to me a few years back.

and that usually requires a certified letter with signed receipt and copy of letter so your ins. co can go after theirs.

We do have paper work from previous claim that the previous home owner's insurance paid out the damages...

I don't think you're seeing what people are saying.

The only "poor guy" is you.

Man it sucks. I know. But I'm married to an insurance agent and this one will be on you.

Correct. It's fairly difficult to prove they were aware of an issue and failed to address the problem.

Also, comp claims don't hurt your rates but you have to pay the deductible

Good, next time don't bother asking. You've been told what will happen, several times, but it's not what you want to hear- we get it.
