Not exactly....but he was performing illegal actions (passing in a no passing zone and invalid drivers' license), and he was ticketed for those actions. Looks like he might get something out of the old man. His history was really the only thing I was waiting for. They would still have to prove intent. I've spoken to several lawyers that have confirmed this as well.


And even the requirements of culpability require that he is "aware" of the risk. In other words: he knew he was taking a risk, and still did it anyway knowing he might hit the person.

Both these guys shouldn't operate any vehicles for a long time.

He could get maximum 20 years, but its highly likely he won't. They'll suspend his license if I ahd to guess, and he might serve some time, but no way in hell he gets 20 years IMO.
