First and foremost, let's hope he is okay. Whether he plays football or not is inconsequential at this point. With that said, if he is a medical retirement, a settlement will be reached and the majority of that contract will not count against the cap.

there's no "settlement" that's going to be less than his "guaranteed" part of his contract. 8 or 9 mill i believe but i'm not a capwiz.

Actually, for retired players, there is the so-called "Barry Sanders rule."
Basically, the signing bonus is upfront money for performance in future seasons. If Fairley retires, the Saints can collect the signing bonus back. Now deals can be worked out or the Saints can decide to eat the money, but if the money is returned, there should be a salary cap credit for the team.
So, I think it would be fair for the Saints and Fairley to agree to a return of $6,000,000 for the future years under the signing bonus in exchange for his base salary ($1,000,000) and this year's portion of the signing bonus ($2,000,000). All in all, Fairley would have been paid six million for 1 year's worth of games for the Saints while the Saints get some refund from the contract.
I could give a more concrete answer but I don't feel like reading the CBA again.

Not to beat a dead horse, and not a homer thing but we couldn't spend a 7th Rd pick La'ell Collins because of a "red flag".
Marcus Peters for that matter.
Both positions of need that have been the difference between a couple of wins the last few years.

Peters pissed me off, but collins made it public he will not sign with a team unless they take him by the 3rd. Per nfl rule; if a player does not sign with the team that drafted him, and there is no trade orchestrated then that player can enter the following years draft. I dont know about the supplemental draft rules. Basically collins was willing to wait if a team drafted him past the the 3rd.

Retiring due to injury and retiring due to disliking your team and or not wanting to play anymore are different situations.

Yes, they are different but are treated the same under the CBA.
Here is the section specifically for retirements:

See no distinction regarding the retirement.
Article 4, Section 9 - deals with forfeiture; starts on page 12 of the CBA which can be found here.

You can add Calvin Johnson to that list too. He paid back over 1m of his signing bonus.
Like I said previously, they will come to an injury settlement. The team could demand the whole thing back, but that leads to bad PR. Fairley's agent knows this, so they will probably let him keep 1-2m of the bonus and it will be accelerated to this year's cap.
