So I'm writing a paper for one of my classes and I need to know what an example would be of a movie that is not protected by the First Amendment. Exclude child pornography, indecency, obscenity, all that. The movie can be hypothetical, doesn't have to already exist. I'm thinking something having to do with treason or ISIS or something.

Let me know what you think. Thanks, all.

Why?

Then focus on a violation of a copyright (e.g., a movie based a book, and someone else already legally owns the rights to produce a movie based on that book). Or, a movie that is no more than an incitement to violence.

How about a film about Islam/Mohammed that some could use as an excuse for an attack on an American ambassador oversees?

Considering Birth of a Nation is protected, and you can't use porn, good luck. I would say something like Mo Jeaux said: an incitement to violence or study the difference between a nongovernment employee and a government employee and their rights to free speech. I can't recall, but I think a nongovernment employee can get canned for talking shite about his employer while a government employee cannot. So a movie written and produced by a guy a GE that slanders GE.

Although if you're looking for something that allows for prior restraint, you'd have to do something like a movie threatening others' lives.

Birth of a Nation could fit...

It could be argued Birth of a Nation was not only defamation (not protected) but incited violence (not protected) - or along the general limitation lines of -"you can't yell fire in a crowded theater"...it's stretch on the second part...but any real threat fits...so in a broad general sense - look for movies that could be construed as so defamatory they could incite violence. That's the easiest for your paper.

No movie is protected by the First Amendment.

Am I understanding this correctly?

Update: I've decided to take this paper in the direction of false or misleading commercial advertising. That is not protected by the First Amendment. Maybe a supplement that makes people sick or a pre-workout that negatively affects muscles in gym-goers.

Thanks, guys for all your insight and advice.
(If you think of something else I could add to make it better, feel free to comment.)
