Survivor Pick Question

Question for folks on how this should be handled.
I'm in an office pick 'em and survivor pool. The same guy runs each, and every Tuesday he sends out an Excel sheet with the number of games we'll be picking and the list of folks still eligible in survivor. We never pick Thursday or Friday games simply to allow folks time to evaluate everything and get their picks in.
Like most everyone else I busted week 2 when the Saints went fart against the Bucs so I told one of my buddies who was still in that I'd buyout his share of the survivor fee, and he could keep picking the games but we'd split it if he won it all.
Well come this week, he and this one other dude are the only guys left. This guy emailed the dude running the league Wednesday and said he'd like to select the Falcons this week. As mentioned, we never bet on any CFB or NFL Thursday night games but he wanted to use a team playing on Thursday night as his survivor pick.
Him and the guy running everything went back and forth for a while and eventually the guy said he wanted to stay with only Saturday (we do CFB too) and Sunday games. Atlanta obviously lost so now the question is obvious. Should he have been allowed to pick the Falcons? I can see why the commish doesn't want to list Thursday games in the pick em just in case people don't get their picks in on time, but if someone wants to use one of those teams for their Survivor team, what's the fault if they get it in on time?

picking thursday games is commonplace in survivor pools
if you are using one of the teams it needs to be in before it kicks off. that easy

I agree with this. However, if these rules were established and agreed upon at the beginning of the year then that's the rules that should be followed. You can't just up and change the rules in mid swing. What would you have said if Atl wins and your pick loses? You'd be fighting this from the opposite point of view then.

How can Thursday games not be allowed. There may be a time where the only pick a player can make is a team playing Thursday. What does he do then? Not play that week? What about the other players. If they pick wrong...is that fair to them?
Or does it work in that if you can't play that week because your only picks available are on Thursday you lose survivor because you didn't factor that into your picks?
