Because the reality is that if he's using the equipment and he's given instructions to others on how he likes that equipment, he's responsible if it's outside of regulations. I don't think that's exactly the same as being guilty, as guilt implies there was intent to do wrong, but is he responsible for it? I think so.
Same thing I would say about PED use. Someone can use a supplement that they didn't know had a banned substance in it. Does that absolve them because they didn't know? No, but it's a reason to believe that they didn't have intentions to deliberately skirt the rules.
