NCAA Loses in Court: TRO against One Time Transfer Rule

BREAKING: In Ohio vs NCAA, Judge John Preston Bailey issues a temporary restraining order (for the next 14 days) that grants immediate eligibility to any college athletes currently seeking it via a multi-transfer waiver.

Next hearing is scheduled for Dec. 27, 2023.

This essentially means for the next 14 days, NCAA can't require any multi-time transfers to sit out while seeking a waiver for immediate eligibility.

Judge will likely decide whether to grant a preliminary injunction—which would likely extend thru length of a trial—on Dec 27.

My goodness. Courts don't belong in sports for non criminal matters.

I would imagine this also establishes a TRO on any outstanding waiver applications denying the same.

Would they make them stop playing? Or would they be grandfathered in? Or if they play from now until 12/27 and the judge rules against it, would those teams get penalized for playing ineligible players?

Unreal. The only way I can see this being controlled somewhat is multi-year contracts being signed by student athletes

To reign it in the NCAA will have to move towards some semblance of a pro model where the athletes are able to collectively bargain with the NCAA. It's the only way at this point.

At that point, football and men’s basketball just need to be minor leagues completely separate from university affiliation.

You have no desire to be a real student athlete for a university? Great. Head straight to the draft or minor leagues instead. No academic scholarships. No ACT “testing sites” to help you score what you need to be eligible and enrolled at a school.

Not even pro sports have this shite. Players are under contract. It's time to do that in college too.

Players are under 1 year contracts in college. That's the crux of all of this. If they transfer out, they lose their scholarship and everything that comes with it.

Unlimited immediate transfers with no salary cap or restrictions on pay for play. Yay college sports!

ETA: hell maybe we'll see a day where CFB is set up like a badly run fantasy league where you can transfer players during playoff season. Team didn't make the playoffs? Oh well, semester's over, all the elite players can transfer to a playoff team and make a superteam!

If this TRO stands, it pretty much is unlimited free agency now.

You already have unlimited NIL creating bidding wars for high school recruits. The one time transfer rule is the only thing really that was holding back the bidding wars for current players.

If there's no limit on transfers, why wouldn't a player put their name into the portal at the end of every season and let the bidding war commence between his current school and any other suitors?

I truly cannot wrap my head around why the government/courts think they have any business whatsoever in the governance of amateur student athletics.
