a pitcher can step on the mound or stride the mound without the ball

he just can't make any kind of pitching motion(s) toward home
(he can just simply step back off) kind of like an appeal

No, he is correct.
Rule 8.05
(a) Straddling the pitcher’s rubber without the ball is to be interpreted as intent to deceive and ruled a balk.
