I suppose this is what his attorneys are gearing up to argue should it get that far. You're being too literal in some respects - the spirit of the 4th amendment and American privacy rights are what are the overriding factors in Sterling's potential defense.
And it WAS out of context - we weren't privy to the entire conversation, the fact that V. Golddiggeriano was supposedly baiting him and entrapping him into that line of conversation.
I support the players personally but I also think that he has the spirit of the law (if not literally the law) on his side. Would be fascinating but bad for the country to go through. I hope he'll just sell for a generous profit to the NBA and apologize and try his best to make amends.
