Chris Spielman files lawsuit against Ohio State

Classs Action Lawsuit

Against Ohio State but not really. He's against images being used when corporate sponsors are involved. Interesting case and I'm behind the purpose.

eh I can kinda see where he's coming from but if I remember right I think we had to sign some sort of waiver allowing sponsors of the school to use our image. I know there was one allowing the school and NCAA to. And maybe that was just a ULM thing or maybe I'm just misremembering since there was 500 forms we had to fill out before we could compete.

Even after you graduated?

Spielman left Ohio State 30 years ago. If they're still using his image in corporate promotions, I understand his point.

I'm not really for it at al. He's been a God in Ohio and was handed jobs left and right after he came back. "Hey guys im a terrible radio host but I went to OSU..". Local station "aight cool you are hired"

It was paid ten fold by the local celebrity his success at OSU brought him

He's donating any monetary win to the Ohio State athletic program. He's doing it for those that don't have the resources to fight the NCAA, et al.

Not sure what this is about, but if they're using images of him when he was a player, he's going to lose that.

"The right of publicity, often called personality rights, is the right of an individual to control the commercial use of his or her name, image, likeness, or other unequivocal aspects of one's identity." See Wikipedia.

If Pepsi or KY-Gel or Fleshlight or whatever used your photo or a video of you to advertise their shite and make $$$ out of it, you would want to be compensated.

That is exactly his point. He doesn't mind Ohio State using his image. His problem is when they attach Honda, Nike or IMG to his image as a sponsor.

I'm totally onboard. If a current (or former) player can't (or doesn't) benefit from their image being used, then neither should the University.

Oh wow.

Yeah I'm in full agreement with him then

Wonder what the line is though, since they are using a photo of him while he was a student athlete there

Eta: and what if the university argues that's a photo of spielman and a Honda ad... Not a Honda ad with spielman

I think a good lawyer could argue that even if that was the intention the practice is negligent at best. Theoretically, the school could be endangering Spielman's personal sponsorship contracts if Spielman had a contract with Yamaha or another Honda competitor.

Man, I really wish Universities would either offer high school student football players either a "pro" contract or a "student" contract.

"Student" contract...rules just like they are now. You get a college degree, we get everything else.
"Pro" contract...rules similar to the NFL (regarding pay, taxes, image rights, etc.)

The 5 stars would be most likely offered pro deals. The 2 and 3 stars that go to ULL, enjoy your degree.

I'm sure there are a ton of reasons why this couldn't work. Just thinking out loud.
