I'll soon be resigning from my position which is an EBR Parish job. I'm wondering if I get my vacation time paid out. It's separated clearly from sick time. I have no trouble finding the laws for private companies, or the state, but I can't track down the law for local gov that says whether or not it must be paid with final check. Anyone know?

Yep they need to pay you for accrued sick time. Should be at the rate of pay you currently earn, not when it was accrued (if you recently got a raise it is at your new pay not old or blended)

quote:

Upon termination of employment for any reason, the employee (or in case of death, the employee's heirs or estate) shall be entitled to be paid for all accrued but unused vacation time subject to the maximum set forth in Section 3.2 herein. (Amended Per. Brd., 12/13/93; Metro Council, 1/26/94, Res. #34705.)

from the personnel handbook. The maximum is 960 hours

Also, be sure to take care of getting your retirement deductions out of the system if you are resigning and not retiring. They don't earn interest for you if you aren't employed with the parish anymore.
