There should not be any penalty. Same thing happened to me a few years ago when I switched school systems. Since she had been covered 9 of 12 months, she will be fine.


The penalty is also less strict for states that did not expand Medicare. So be thankful you live in redneck Republican America.

To answer your main question, a gap of 3 months or less in coverage is an exception to the penalty rules. So your wife should not owe a penalty as long as the gap is held to that.

But I'm confused about the length of it. If she had coverage until end of July, and new coverage starts Oct 1, that is 2 months, not 2.5 months.

You have 60 days to elect COBRA - this would be the 31 days of Aug and 29 days of September. If by Sept 29, she gets sick or hurt, file for COBRA, otherwise, don't bother.

On Sept 30, you may want to tell her to stay in bed and sleep all day
