Insurance mediation tomorrow morning

I was in a wreck almost two years ago. I was rear ended by a commercial vehicle at a red light in BR. I was stopped and he hit me going 50MPH. Anyway last two years have royally sucked. I have had 3 surgeries including having a spinal cord stimulator implanted. I am starting to get my life back.

Anyone been though A settlement mediation? I am hopeful we can settle. I have really good firm representing me.

I have a friend who was in a similar situation 20 years ago. Stick to your guns. What may seem like a large sum isn't really that much spread out over the rest of your life(even with a successful career), and your body will permanently be affected by the driver's actions.

No real advice for you, but I wish you the best.

Good luck, as you and your counsel well-know, the insurance company for the responsible party look at your case simply and coldly as a monetary value to be kept to a minimum. It's not personal, it truly is just their business. That is their job.

I hope your attorney(s) gets you everything you deserve.

Hope for the best for you. I wasn't in a car wreck, but I am up against a living legend physician who screwed up a nerve issue. I'll be having another surgery soon.

As mentioned, their insurance company is just trying to see what money cn be saved, so stick to your position. They do not want to sit in front of a jury if avoidable, yet they won't want to pay what a jury would award you.

My cynical take on mediations is that it is no more than an opportunity for insurance defense counsel to get in front of the claimant and see how much money the claimant is prepared to walk away from.

You were injured in an MVA. It appears that there is liability and coverage and, likely, no big factual/legal issues are prevalent. It is all about the $$$. This is something that could settle with a phone call.

If the mediator appears to be cramming down your injuries to enable a settlement, do not get pressured to settle. If you don't like the offer, resist the temptation, the matter may settle the next morning with a phone call between counsels.
