Anyone ever register a trademark?

I’ve actually been exploring this as well on copywriting a logo for my company.
From what I’ve found, it can take awhile and it’ll cost somewhere between $1k-$2k.

In the process of doing it now. It takes about 18 months from start to finish. I paid the company $950 to do it and then had to pay the government $350 to file the application. It's been going on since February and I get updates periodically on my status.

Cool. Thanks. I just started researching yesterday, and I kept finding myself on legit looking affiliate sites that were offering to do a Trademark Check or something. It looked real enough to confusing. Not sure if the site was connected or just a service. When I find the link again, I'll share it.

This is where I sort of got confused when researching...

how long does it take for them to figure out if the name is available and the likelihood of approval (if the latter is an option). Or is there a way to confirm ourselves if the name is taken?

So, about how far along are you? Any idea your chances of getting it?

Would love to chat or if you have any links to point us in the right direction would be great.

What's with all the "$189 US Trademark Filing" ads when searching on google... is this something like the LLC programs where they say "Hey, it's only $49 to register your Business."

..then at check out it ends up being around $300-400 dollars.

I see those ads, and there's gotta be more fees tacked on...

I can see how the searching process could become a confusing labyrinth for the unfamiliar. I've seen some pretty frickin wicked-awesome affiliate sites... but Would love to take the faster route to learning the procdess.

I'm not sure about those ads. I just went through a company that does it for a living because I don't have time to research and try to figure it out myself.

They research that info for you upfront and give you the results of the search. They'll let you know your chances of being approved before submitting to the trademark office and submitting that $350 fee. I used The Trademark Firm based out of Florida. LINK /

Have had this done several times as part of brand development work. You don't necessarily need a firm to help you out, but they can certainly accelerate things.

The $189 is most likely their fee. Filing a trademark costs $250-$350 for the initial application fee, depending on the type of submission. There are more fees associated with different filings. That said, a lot of the services are scheisters.

If you're looking for a service, I would highly recommend either using an attorney or a firm that can verify they have an attorney on staff to help with the specifics of the filing and to make sure you have adequate representation if needed. May cost a little extra, but you get what you pay for.

Here's the link to the trademark office search tool. YOu should be able to find all the trademarks associated with the name you'd like to use there. There is flexibility with similar names that are in distinctly different industries e.g. Titan Energy vs. Tennessee Titans.

Are you concerned about being able to receive statutory damages from folks who violate your copyright?

Copyright legislation from 1978, dictates that all works are automatically copyrighted from the time that they are created and “fixed” in some recognizable way.

You can send a cease and desist if someone is infringing, even if your not registered. You have to be registered if you want to sue for damages. Even then, legal fees are an expense you may not want to pay.
