Intellectual property is that the source of the material is and belongs to Nintendo. In other words, Nintendo coined/created/thought of it themselves. It is basically what it sounds like. A thought or creation from the mind of one or many persons.
When intellectual property is made and or distributed, whether it be a game, music, etc., it can't be touched as far as use by an outside entity unless given permission and ultimately finalized by said source.
Idk if that answered your question, but there is a bylaw that exists when using such material that allows you, in most cases, to bypass these restrictions and use it for entertainment purposes as long as it is non profit and fan-based. Or otherwise a parody. People in the past have used the loophole of "parody" to make different videos, movies, games and such as they please. It's a bit complicated but not all that hard to get past if you just know what to say and how to go about it.
I believe it is called the Fair Use Act? Correct me if I am wrong. Looks like I just had a halfway incorrect rant of something I really don't know all that much about Sombody back me up on this

The system is broken. bungie, valve, blizzard, ubisoft, and most other devs and publishers don't raid their fans' piggy bank for playing their games. nintendo, on the other hand, doesn't hesitate to fleece their fans on YouTube for such a "criminal" act, yet inconsistently allows players to profit fully on other channels.
So, don't buy or support their shite?

Here's the solution, don't post Nintendo games to YouTube.
They aren't. I've already seen massive Let's Players say they are done with Nintendo because they have a ton of other games they can play.
It is such a shame because Nintendo games are a great set up for Let's Plays.

You can't have one without the other. The Youtubers wouldn't have an audience without the games to create the videos.
Ehh they will always have games out there to play with how many indie titles are pumped out nowadays.

It should be a mutually beneficial relationship which it seems like Nintendo is trying make it that way.
It already is though. I can't tell you how many games I was swayed to buy because Achievement Hunter or Inside Gaming made a video of them playing it.
Games like Minecraft and Day Z are huge examples of this in the gaming industry.
The free advertising they get from these personalities is what is so beneficial.

You used two indie games to make your point. Let's not act like Nintendo really needs nearly as much free exposure as indie games do.

One of those indie titles just sold for 2.5 billion dollars.

Like you said Minecraft did need Youtube at the start to grow. Nintendo really doesn't need Youtube in the same sense.

Wouldn't hurt though. It isn't like they are exactly killing it in the markets where these youtubers are so popular.
Posted on 2/6/15 at 5:35 pm to stout
They might not need YouTube, but they sure as hell could benefit. I buy a lot of my games based on YouTube videos.

Not really, but thanks for the attempt.
It's not like people are claiming that this is their game and they've created it and then selling a product as their own. They're just playing them and commenting on them. If people want to sit through a commercial to watch me play a game, so what? Ya know? Maybe I'm preaching to the choir on this one.
I don't understand the differentiation between a product that can be used to make something else and intellectual property. I pay for something and use it to make something else. Seems pretty simple to me, but IANAL.

It's their product. They're welcome to do whatever they want to with it. They have every right to take people's content off youtube if they don't like what's attached to their product. I don't necessarily agree with it but the people that are pissed at Nintendo need to get over themselves.

I don't understand why this is even argument.
The argument should be just how dumb of a policy this is by Nintendo.

It is dumb. But it's what they want to do. I'm not going to be mad at them for wanting to make money off of their products being broadcast for free on the internet.

People aren't watching because of the games...
Plus they are making money off the advertising they get

Uh, what? Have you never watched Lets Plays or How To videos on YouTube?

Not directly. They weren't getting money from videos that had their games with millions of views. Now they will.

No they won't because people won't make Nintendo Let's Plays.
The potential profit is too small and the process too tedious.

They have a reason what they do. It doesn't have to make sense to everyone else because they're fricking Nintendo. Reggie says deal with it
