Sooner ot later, it'll come back. Hoping against hope that the game, if it goes back to EA, is actually any good. The game hasn't changed since 2003 in any meaningful way. It's way past time for a next-gen level football game.

I too feel like it'll make a triumphant return one day. It's too profitable and the demand is too high for it not to. However, that snippet is just speculation by the court as part of its findings on whether there were damages and has 0 bearing on it actually happening

That's what I've been wondering. The NCAA and players don't own the concept of college football. Let all the school colors, conferences, and player likeness be crowdsourced by the consumers. It basically already was anyway. I would think a company could avoid any lawsuits then by saying all they did was allow the player to have customization options and share it with their friends. If a random kid decided to spend a whole day making every school and uploading it without seeking profit, I don't see the issue.

A plaintiff could contend that this is just a work-around, a loophole. Vast majority of people would immediately download the real schools, real names, real likenesses. And that the large bulk of demand for the game, EA's profit, comes from the consumer understanding that you will be using particular licensed entities.

That plaintiff would be correct

Do you know of a case where the plaintiff won with that sort of argument? I mean I agree it's certainly obvious that's a loophole, but I think some courts might be reluctant to rule that way. If anything I'd think they would just require the company to police the servers and take down alleged infringing materials uploaded by users, ala YouTube. YouTube allows users to post videos and isn't liable for copyright infringement as long as they take down videos that are flagged for infringement. But YouTube and its user-sharing community is fine otherwise. I would think a generic football game could operate in the same manner. We'd just have to download all those custom rosters before they're taken down.

Also, although it's not in the same realm of intellectual property, you could point to other products that are perfectly legal despite the fact that everyone knows they are used for illegal purposes. Bongs or other drug paraphernalia for instance. I've read cases where the court was satisfied with the fact that there exists legal and legitimate uses for the product and it is not the companies fault that people choose to go beyond its intended use.

I know they officially pulled the plug once the P5 conference all pulled out and wouldn't allow EA to use their logos.

I'm thinking they are questioning how many people would buy the game if everything in it was generic. Nothing but generic teams, stadiums, conferences and uniforms. Would be a hard sell to the general public even if things could get modded or customized.

Hopefully NBA 2k16 will open the door to schools allowing them to make a game if every player if 100% generic.

I don't partake in many basketball games so I woidlnt know.

I'm prepared to offer you no examples or evidence to support my claim, but I've been gaming for 20 somethin years and stayed at a holiday inn express last night.

Not to mention that developing a game engine for a CFB game would likely be costly.

Where they screwed up is when they had Nessler record common voiceover names like "Tebow" and "Perriloux".

Nothing in that is suggesting that any college video game is coming back. In fact, it is arguing that the NCAA is in the wrong because they could potentially start back making the game and that potential is being taking into account in the proceedings.

I think 2K really has. All they have to do is just piggie back what they have done already. Go to the schools and conferences, not the NCAA, and get a exclusive license to make a football and basketball game. It would kill.
