Dear Texas - WTF?

Snippets:

quote:

A Texas man has been ordered to come up with more than $60,000 in back child support for a girl he did not biologically father and met only once in his life.

Gabriel Cornejo, 45, was named by a former girlfriend as being the father of her child in 2003, FOX News states, but the parental title was never confirmed by the alleged dad himself.

quote:

(Regarding a DNA test) - Cornejo eventually did just that — and was found not to be related to the girl.

quote:

However, that doesn’t mean much to the girl’s mother or Texas courts, who are still suing the innocent man for the full amount of child support the “absentee dad” now owes: $65,000.

quote:

“[By] Texas’ family code, chapter 161 states that even if one is not the biological father, they still owe support payments that accrued before the paternity test proves otherwise,” FOX News explains of the law.

quote:

As for the deductions in his paychecks, lawyer Carel Stith, the ex-girlfriend’s counsel, surmised that as the money was taken out of Cornejo’s earnings years ago and he never once contested the missing dough, he’s technically not owed anything now.

Family law in texas is absolutely brutal to men. In fact, its probably the worst in the country ever. It's like sharia law in reverse.

One of the things I hope about gender equality laws in removal of the automatic "benefit of the doubt" the law places with mothers. A father can lose custody of their child if they have a single DUI; a mother just about has to kill some people. Being the better parent is rarely a factor.

Every potential father should have a DNA test done immediately.

Some reports show numbers as high as 25% of the listed father is NOT the biological one.

In Louisiana support does not accrue until judicial demand and is not retroactive. States that allow that are ridiculous.

This. Many states have laws that require a man to challenge paternity within a specific amount of time. If that doesn't happen, he is the presumptive legal father regardless of the outcome of a DNA test. Every single man should request a paternity test before his name is affixed to a birth certificate, especially in cases where the child is born out of wedlock.

With a bill that high, it is worth it for that guy to take that to the highest court he can. Is there somewhere to donate to his legal fees?

God this is so ironic. I just finished taking the TX bar exam and learned about all the presumed paternity laws in TX. Sounds about right.
