It would be semantics if I was trying to justify a tyrannical use of the taxing power by saying "well, it's legal, so it must be ok", but that's not what we are talking about.

When you say "taxation is theft", you are implying that there is no justifiable taxation.

You can make a solid argument that some specific taxes, certain levels of taxation, taxation without representation, double taxation, etc amount to "theft", but you can't be taken seriously if you deny that there is such a thing as justifiable taxation.
