The special counsel's source of power is from the executive branch itself which is the President of the United States.

The special counsel doesn't have his own powers as special counsel, he's carrying out the President's powers with his permission and he does not have permission to subpoena the president.

The only one who can legitimately check the President is Congress itself with its impeaching power. or you can beat him in a regularly scheduled election.
