Tell him if he is 16 he is not supposed to be driving after 11pm or with another kid in the car except under certain circumstances....already breaking the law..

Do yourself a favor stop him cold from using his cellphone while driving...look up Cellcontrol. It works.
My kids hate it, but it stops distracted driving.
