It is a losing argument any way you slice it. Most companies also have some sort of policy in their employee manual that forbids employees discussing/disclosing their wages with other employees. So, if she brings up what someone else is making, she immediately opens herself up to termination on those grounds.

Besides all that has been stated, good luck trying to find another job. If she came apply with me, I would laugh her out of the interview and simply state this lawsuit.
