The team of Scalia/RBG was actually a fairly good one for 4th Amendment issues, about the only thing RBG ever got right.

I agree with you on that, but Scalia's opinion in Gonzales vs. Raich was the most intellectually dishonest and incongruent opinion I've ever read, especially given the precedent in the Lopez and Morrison cases.

Yea, the court's generalized makeup is much less true in criminal cases.
