Yes but smoking indoors is considered a public health issue due to the well known and documented risks of second hand smoke to others.

If you owned a restaurant, if you were doing something that could be a public health issue(ex: serving contaminated meat)...you would get shut down by the health department would you not?

If you had a sign on the door that said "WE SERVE CONTAMINATED MEAT" then I would think this is a good comparison

Yes smoking is harmful. Yes second hand smoke is harmful.

If I own the business, and the building, I should be able to have a choice. To allow or not allow smoking.

You'd have to have some serious violations. Chipotle got people sick, they are still up and running.

Jack in the box killed people, they are still up and running.
