Yeah he can.
If I am under investigation and I prevent the cops from investigating me, I'm obstructing. Doesn't matter if I'm innocent of the original crime.

Reminds me of the man who escaped from prison and while on the run it was proven he didn't commit the crime for which he was convicted.
They then convicted him of escape and sentenced him.
