Police arrested the women for failure to disperse, resisting & aggr. obstruction of a highway (a felony). Two also face additional count.

The DOJ was investigating whether or not there was a civil rights violation. The state would investigate it as a murder, manslaughter, etc. But yes, if there wasn't enough evidence for the DOJ to bring charges, it seems unlikely that the state would pursue it.
