I would say no personally. But when it comes to local government, what's acceptable is what the people in their jurisdiction feel is acceptable. The people in Berkeley? Yeah they probably don't give a shite. Freedom of Speech means nothing to them. They've already proven they are scum.
ETA for clarification:
My point was more about getting and staying elected. Locals determine who holds that office. If they aren't bothered by his membership in the group, then it's okay for him to be a member. That doesn't mean he can do whatever he wants just because they support him. That isn't what I was trying to say. I realize it may have come off that way. In the south in the 60s, people did things that were illegal. The locals were okay with it. They stayed in office. That doesn't mean they were able to continue to break the law. That's when higher powers stepped in and put a stop to it. The same will happen eventually in Berkeley if this doesn't stop.

No it's not. Laws are laws. Protected rights are protected. I don't care where you are in the US.
