I think this misses the broader issue.

The left may use this argument, but that isn't the only manner by which Trump's tweet could be/was incorrect.

The real question is whether there is any legitimate argument that Obama had TT "tapped." That doesn't mean a physical 1980s wiretap, but it does mean surveillance targeted to Trump/Trump Tower, not communications picked up ancillary to other monitoring.

Well, here's where it gets really convoluted. If the Obama administration intercepted inoccuous communications and retained them despite no intelligence value, does it become direct surveillance? Or as I've stated, they used indirect legal methods to perform the surveillance? And then once they unmasked the citizens and dissimenate the information does it become illegal direct surveillance?

A better question is under what circumstance did Flynn's name get released and his conversation transcribed? An even better question is under what circumstance could WH acquire surveillance of Trump campaign and not disclose immediately? If this were a Rhino in the WH who did that to a Dem, it would be watergate 2.0.
