They both have intrinsic value, but they both also are born with free will. Well, unfortunately the unborn baby isn't but theoretically he/she has it. A person can be deemed so harmful and dangerous to civil society that they cannot be allowed to live. And whether we like it or not, the death penalty also serves as vengeance for the victims and their loved ones. And for those who look at it from the religious angle, there isn't a prohibition in the Bible that the State cannot take a life through its own mechanisms.
