Legal Advice and Personal Attacks Required Within

How do I get myself into these situations?!?!

2 weeks ago, my valet guy shattered my driver side view mirror and tore the housing up on my F150. He meets me that afternoon to apologize and prepare me before I see it. Dude says, "I'm sorry. We'll fix it, I'm already looking up parts on the internet."

I say, "Whatever, just get it fixed."

A week goes by without another mention. Granted, I see these people 4 times a day Monday through Friday.

Last week, I asked for an update and the guy who broke it gives me his boss' phone number and tells me to take it up with her. So, he wasted 4 days and didn't even tell his boss what he did.

I get in touch with the owner and explain the situation. Her response, no lie, was, "Well, let me talk to them and make sure they actually did it, and we'll start the process from there. You'll need to get me 3 bids, but wait until I clarify with them it is our fault."

Did she just accuse me of lying to her from the get go?

So now another week has gone by without any contact, and I'm still without my mirror. I don't have time to take off work and spend the day letting 3 different collision centers look it over to give me an estimate. Nobody will do it over the phone, I've asked.

So legal question: Is it my responsibility to do the leg work for them? Would I be due compensation for missing work to get the bids? If I just go get it fixed and hand her the bill, can she wiggle out of paying it because it wasn't authorized by her?

Why does this shite happen to me?

Just tell her she's got until the end of the week to cut you a check for the fair market value of the damage repair or you'll see her on The People's Court

you don't really have a responsibility to do anything you don't want to do. that said, i'd get ONE quote, send it to them with a letter telling them they can either pay you the money or arrange directly with the repair shop to do the work. if you want to make sure it gets done, get an attorney to send the bill and a letter threatening suit if htey don't take care of it. you aren't required to do even this amount, but this is the way it will likely be taken care of.

eta: you don't have to use an attorney, but people tend to take these things more seriously on letterhead.

Call your insurance company and let them handle it for you. This is what you pay them for.

1) should've called your insurer immediately. Waiting this long doesn't help.

2) you sure as hell don't have to get three quotes. Get one and tell them to pay it. Valets are required to have pretty substantial insurance to operate in the state - you're not going to break their back.

He's a minimum wage, valet employee. Do you really trust him to "be on the ball" and fixing your truck?

Have you ever been a boss or in charge of anything at your job?

You're just going to trust anything a random person(that's what you are to her at the time, not a bad thing, just facts) and take their word for it?



Also, call your insurance company, and they'll do the legwork for you. That's why you pay them every month, use them.

In my opinion, if you wanted your shite fixed the right way and in a timely manner, you should have taken care of it yourself.. how can you rely on the same slapdick who messed up your truck to get the MFer fixed?

You should have contacted his boss right away because now you have lost a little credibility because you waited so long to contact the right person - that's why she had to check to make sure her employee actually did it

and when you are done, find somewhere else to park because those valet guys are going to do something to your vehicle in revenge for getting their friend in trouble.

So you have a "valet guy", but no insurance agent or a lawyer?

They are the ones that need to be getting this done and doing the legwork, not you.

You shouldn't be out out anymore that just the bare minimum for someone else's frick up.

WTF is a "valet guy"? I am familiar with the terms, but not exactly sure what you mean.

Also you should go get an estimate or have an estimate done by who you want to fix it. It's your vehicle and you deserve to be made whole. Including having it fixed by someone you trust.

They should have an adjuster, thru their insurance, that can come look at your vehicle and verify that the estimate is in line with what it should cost.

The last time I was in an accident the adjuster came and checked out my truck and cut me a check in the spot. They have software programs that give them the labor and parts prices and I believe most body shops go by the same thing now.

I'm no expert, just how it was explained to me. I thought I would have to do the three estimate thing and had actually already gotten one of two when I was told that's no longer how it's done.

Actually the last two times I've had to deal with auto insurance the adjuster either met me somewhere on my way home if the truck was OK to drive or they came to my house.

Got checks then and there both times. They have a little computer with a printer they carry around with them.

You can try to get the garage or their liability insurer to pay you directly, but they will string it out and quibble until you go insane. Meanwhile, you have no mirror.

Consider doing what I've done twice before when our vehicles have been hit by others who were at fault. I called my insurer and immediately got my car in the shop for repairs, covered by my collision coverage. No waiting on the other party or his insurer.

My collision insurer then got with the at-fault person's liability insurer and handled all the PITA of getting them and me reimbursed. I also got a check to reimburse me for my collision deductible. My insurer assured me it did not affect my rates since we were not at fault, and it did not.

It's worked smoothly twice for me with State Farm. Your mileage may vary.

Do they have cameras? If so, hopefully the footage has not been overwritten. Should have a date/time shot of when they went in with no damage and when they came out with damage.
