I think it is based on the fact that WVU did not pan out all the things they promised Rod. This would perhaps be not following the contract in good faith...so there may be some wriggle room from Rod on this one.

I heard it from the Duke on ESPN Radio.
Basically he said RR is alleging fraud, bait and switch was used and the buyout in the contract is not what he agreed to originally.

I'm guessing he will end up paying the original buyout before his contract last year. I think that was 2 mil.
