This does not seem to be the case since the motion to suppress sounds to have been filed based on the argument that consent given in response to deception is the same as consent given in response to coercion. It isn't though, and AFAIK this has been thoroughly established in past case law.

Anyway, presumably there isn't a question about the legality of the stop itself since this wouldn't be at all newsworthy in that case.
