If he had checked out pre-snap and told the line he'd be ok, but yes, post snap changing the play to a pass he risks a penalty. It's possible to get away with it if the line is basically running sideways as opposed to forwards and the pass is very quick, or if the pass is behind the line.

Tomsula later came out and said Kaepernick is able to audible out of plays but honestly I think he's not and if he is, the coaches are at fault for not building checks into the play (i.e. read coverage to both sides).

Something like that doesn't just happen in the QBs head on one snap, it's more than that. It shows that the team and coaching structure is rotten to the core. Which is unsurprising given that the FO brought in a bunch of guys who'd failed elsewhere to surround a guy who was on no ones hot list as the next big thing at head coach.

The 49ers offense is abysmal, in part because it's so vanilla. They could've had Holmgren, Shannahan, Gase or just kept Harbaugh, but they wanted to go young, and win with class.

If he does a 1 step drop, there is no way the linemen can get up field fast enough. A lot of the top tier QBs do this several times a season. Now, if he does a 3 step drop or fakes the handoff, then you are correct he'd get flagged immediately.

And, since he'd be in the endzone, after the 3 step drop, I believe the penalty would have been a safety?
