the sniffer test for diesels doesn't test for Nox...they test for opacity...40 is allowable... there are tuned trucks(with an EGR delete) scoring 3 on the sniffer

testing for Nox will only take place on trucks \that have after treatment systems...we are talking EGR deletes not DEF correct?

NOx and SOx have been regulated on Diesel engines for a while now. It isn't only applicable to vehicles with SCR, that was just needed to meet the final emissions tier requirements. I'm not sure what the timeline was exactly but anything we're talking about deleting anything off of will be subject to the limits that were in effect when the vehicle was built. If it has electronic injectors it was certainly regulated. The regulations were implemented in 4 "tiers" of NOx, SOx, and particulate matter emission levels.

ETA: the test will be changed to sniff for everything in light of the recent Volkswagen scandal. Retrofitting a truck back into emission compliance will cost much more than deleting it did. I don't recommend it.
