That's the crux of the issue, it didn't matter if he did it or didn't, the NFL failed to follow their own CBA.

The NFL attempted to use the same strategies against Tom as they did against the Patriots as a whole. Not allowing the NFLPA to question Pash, attempting to apply steroid suspensions to equipment issues, and not even abiding by their own CBA with punishment guidelines doomed them in the end.
