This is only a perceived flaw by people who get to argue about hypothetical situations that don't require proof. The difference in any real life situation is that different people have different perspectives and remember things in different ways. The laws are pretty clear, but you have to sort out the facts and that sorting process isn't always going to end up in favor of the person who thinks that they reasonably believed that they needed to pull the trigger.
