This isnt a criminal case. If I am a juror I want to know if Stewart played any part whatsoever. And without doing research, as an unbiased juror I def want to hear the case as the person who happened to hit Ward was the same person who he had a confrontation with. It seems that Ward def has the most blame as he walked onto the track like you have mentioned a million times, but did Stewart actually do everything he could to aboid the collision? Or does he have some blame as well? That is why this case is far from actually being frivilous.

Impossible to prove unless he comes out and says, yes I wanted to hit him and did.

Has nothing to do with Ward getting out of his car and getting in front of Stewart during a race.

It's only not frivolous if Stewart admits anything. Until that happens, this is a giant waste of everyone's time.
