Here is a Wired.com link for all the idiots who are buying the bullshite coming from Roger Goodell and the NFL. For those of you who are too slow to go and read the whole article, destroying a cell phone does not destroy any evidence. It only destroys the device.
The idiots at ESPN should all be fired. Goodell should be fired.

That article assumed Brady was using hangouts (which isn't the default texting app for Samsung devices), then speculates about how the data could be recovered if he had an iPhone instead of the Samsung he had.
Brady told the nfl he destroyed the phone and sim card, as is his ordinary course, and that they had checked with his carrier to see if the texts could be recovered, but were told they couldn't.
Also, he waited until right before the appeals hearing to do this.

Goodell botched the whole thing with the saints a few years back with the whole bountygate thing. I wouldn't be surprised if he is doing the same thing here.
