The way the economic loss claims work, you don't necessarily have to have a loss in 2010. They analyze a 5 year period by month. If there is a 3 month period in each year that trended down in 2010 and remained down or went up a little in 2011, you can potentially get money.
It's not the cash grab people would have you believe. It's a cumbersome calculation and BP appeals most of them in the hopes of disqualifying the claim or hoping the claimant gives up or forgets.
IMO, shame on those who know they weren't affect at all (looking at you, funeral homes)...but, BP was also not smart enough to challenge the parameters of the claim process. They agreed to a very open ended calculation process, so many of these claimants are well within their rights as outlined by the settlement language.

And I've always thought this attorney was reputable (just from hearing others talk), but my view of him is much different now.
Like I said though, not surprised at all at how low people will go for a dollabill.
