The courts will decide.
Regardless of that, based on personal experience I will always consider Rita an insufferable person. Until I hear something other than totally unfounded conjecture from posters on the internet, I will continue to hold Gayle in high regard.
The 3 R's have no more "Right" to Tom's estate than Gayle. Whatever he chooses should hold complete sway, assuming he is found competent.
I really hope he is found competent.

As to Benson the family is headed to court which is never good.

Tom's lack of competency does not make up for Rita's lack of competency. Even If he may not be in his right mind I still don't believe they are suited to run this.
