Exactly, and it has never been an issue when dealing with companies such as Allstate or State Farm.

This is why you purchase insurance from a reputable company, and let them handle the repairs, then subrogate. They even will collect your deductible.
If you want to fight the other side, you really have no leverage until you sue them.
