The police were responding to calls from the area stores about Gardner's activities. N.Y has one of the highest taxes on cigarettes in the country & individuals selling individual cigarettes is a huge problem for stores that sell them. The store owners in the area had pointed him out specifically as an habitual offender & he was known to be extremely verbally abusive to store owners. He was not arbitrarily picked out by NYPD to harass. As the new shirts state: "breathe easy, don't break the law".
