U.S. District Judge Carlton Reeves on Tuesday handed same-sex couples a victory in their quest to overturn Mississippi's gay marriage ban.

Reeves granted a preliminary injunction blocking the state's ban against same-sex unions as sought by the Campaign for Southern Equality and two lesbian couples who had sued in the state in federal court. But the judge also postponed the injunction from going into effect for 14 days in a legal maneuver called a "stay."

This means same-sex couples cannot yet obtain marriages licenses in Mississippi.

In his 72-page order, Reeves said "Mississippi continues to change in ways its people could not anticipate even 10 years ago. Allowing same-sex couples to marry, however, presents no harm to anyone. At the very least, it has the potential to support families and provide stability for children."

Reeves' decision came the same day as that of a federal judge in Arkansas who ruled against that state's constitutional amendment defining marriage as between a man and a woman. Their rulings join a string of others recently striking down gay-marriage bans in states across the nation.

Well dammit, Mississippi will finally not be last in something.

Arkansas also had theirs thrown out today as well.

Congrats Toddy.

Won't last. The state will find a way to put it back into place.

Gays were "banned" from marrying in Mississippi?

Really?
What was the penalty?

Two consenting adults of the same sex were banned from getting marriage licenses from the state. So yes, it was a ban in fact.

They were denied benefits of a marriage recognized by the state that a couple composed of a man and woman enjoys.

One Judge stomping on state's rights is not "Mississippi changing" at least not in the wishes of the people here. Just more FedGov tyranny pushing an agenda.

And I have no problem with gay marriage, but I believe change should come at the will of the people

Exactly how I feel. This is nothing more than the fed trampling over state's rights.

Fools like you are happy that the will of the people is being thwarted, very telling what kind of idiot you are.

Perverted laws will not stand.

just a matter of time.

Silliness.

OTOH what folks here do not seem to grasp is that words do mean something.
The term "ban" means something. It is consistently used inappropriately in application to Gay Marriage.

E.g., Interracial marriage was banned in Virginia. Loving was ARRESTED as a result.

Gays were not banned from marriage in Mississippi. The state simply did not recognize the term as applied to same sex individuals. Married gays were not arrested. They were not fined. They were not forced to leave the state. Nor were they banned from any legal benefits as far as I can tell.

Gays had the right to marry in any willing church or any gay-friendly civil ceremony,
and they had coincident legal rights to obtain a:
* Health Care Proxy
* Durable Power of Attorney
* Joint Tenancy Agreement
* Will
* Cohabitation Agreement

* with regard to state taxes, the advantage in MS is to file separately as far as I can tell:
Mississippi collects income taxes from its residents utilizing three tax brackets.

For single taxpayers:
3 percent on the first $5,000 of taxable income.
4 percent on taxable income between $5,001 and $10,000.
5 percent on taxable income of $10,001 and above.

Married couples filing a combined return (i.e., both spouses work) can opt to have each spouse calculate tax liability separately and add the results.

So in terms of denied benefits, I'll ask again,
Which specific benefits were denied?

This is basically the state of secular marriage anyway, might as well make it the official model for everybody heteros, homos or polys.

The word "ban" is used just fine here. Homosexuals were legally prohibited from marrying. That's what a ban is.

Could my state please just accept this and move on. It would do our reputation wonders if we were the first Southern state to make gay marriage legal.
