at the end he kills someone in a self sacrificing manner, not that I'm opposed to that, but he never murders anyone
he does it plenty in the first two
star wars - almost kills some officer talking shite about the force, chokes a rebel officer to death with his bare hands, cuts down obi wan
empire - chokes about a gazillion officers for the slightest mistakes

I dont really see why him not killing the shite out of a random officer in Jedi is an issue.
Hell, he was clearly conflicted about his role once he comes in contact with Luke. The first time Darth gets him alone in Empire he practically begs Luke to join him and refuses to take a kill shot even though he could have easily done so. One could easily surmise that interacting with his son softened him greatly.
