If you get paid by the hour, obviously not.

Point was that the government won't allow her to make it up by working 44 hours next week. Or more accurately, if she wants to do that they make it more expensive for the company which isn't fair to either side--she just has to give up that earning opportunity when it's in the best interests of both sides to let her have comp time.

I don't think the gov't. gives a shite if the employer lets her make up the time, even though she wasn't there when they needed her. Like most laws there's some good some bad, but the thrust of the family leave law was to allow time off for these kind of things without some form of punishment by the company, even though that scenario wasn't quite a "leave," it kind of falls under the scope of it, she had to take care of personal business on company time, was allowed to, and wasn't penalized for it
