Because maybe they don't have sufficient evidence or grounds to charge him with it? I don't know, I haven't had the chance to review all of the available information.
But the people whose job it is to do these things haven't seen fit to charge him with terrorism. Instead, he's charged with murder and will face the death penalty. But by all means, continue to push some convoluted conspiracy theory.
